Buyer’s legal guide Buying a property in Turkey is far easier than in most other European countries. The process is not complicated but there are some formalities you must go through. Here we will give you a step-by-step guide to the purchasing process:
- 1.st Step: When you have decided to buy a property we will give you a photocopy of the property deeds and we will ensure that the area map and parcel numbers correspond to your property. At this stage we will need a copy of your passport and 6 passport photographs. We also need the name of your mother and father. This is normal in Turkey and is required for identification purposes.
To give us the authorisation to carry out all the necessary legal procedures you must sign a power of attorney (in turkish:vekalet). The power of attorney includes the right:
1 to purchase and register the property in the name of the buyer 2 to forward an official registration to the municipality department 3 to recieve the completion report for the property 4 to arrange payment of the local taxes 5 to assist with after-sale services (help with payment of bills etc…)
- 2:nd step: You will now be required to pay a deposit of approximately 10 % of the purchase price. In addition you will need to pay legal taxes, expenses and Agent’s commission. These costs are approximately 5- 6 % of the purchase price and a full breakdown of these costs will be provided.
- 3:rd step: We will prepare a letter, a copy of the legal documents and a copy of your passport and forward these to the authorities.
- 4:th step We advise you to open an account at a local bank before you leave Turkey to facilitate the transfer of the remaining money.( MemosHome staff will be pleased to assist you with this )
- 5:th step When all the checks have been conducted and the papers have been returned to us, we will contact you to arrange a suitable date for your return to Turkey to sign the contract and undertake the money transfer. To receive the title deed (Tapu in turkish) takes approximately 6- 10 weeks.
- 6:th step On the day of the money transfer, the Buyer, Seller and Real Estate Agent will go to the Title Deeds Office and complete the paperwork.Throughout this process a fully certified translator will attend to translate the necessary contracts. The paperwork consists of all the legal documents ( title deed, land registry etc ) and financial issues. Financial affairs are now concluded, signatures exchanged and the title deed of your property is registered in your name.

Registration at the Title Deeds Office: Approx. 25 €
Certified translators: Approx. 40 €
Power of attorney: Approx. 100 €
Promise to buy and sell contract at the Public Notary Office: Between 200- 600 € depending on the value of the property
Sales commission to the Real Estate Agent: 3% of the property value
Property tax: 1 % of the property value
Annual costs:
Rubbish and Property tax: Approx. 50 €
Water New connection of water meter: Approx. 60 € ( this is an one-off payment ) Name transfer of an already existing water meter: Approx. 30 € ( this is an one-off payment ) Water cost/ m3: Approx. 1 €
